1. Acceptance of Terms

By creating an account, browsing, purchasing, or downloading any content from Penguin 3D AI, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must not use our platform.

2. Account Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Intellectual Property

All 3D models, designs, images, graphics, logos, and other content available on Penguin 3D AI are protected by intellectual property laws. The original creators and Penguin 3D AI retain all rights, title, and interest in the content unless explicitly stated otherwise in a license agreement.

4. 3D Model Licensing

When you purchase or download a 3D model from our platform, you are granted a limited, non-exclusive license subject to the following terms:

• Use models for personal and commercial jewelry production
• Modify models to suit your specific production needs
• Use models in physical manufactured products

• Redistribute, resell, or share the original model files
• Claim authorship of the original 3D model designs
• Use models to create competing digital marketplaces

The license is non-transferable and limited to the purchasing account. Violation of these terms will result in immediate license revocation.

5. Purchases and Payments

All prices on the platform are listed in US Dollars (USD). Purchases are processed through Lemon Squeezy, which acts as our Merchant of Record and appears as the seller of record on your invoice and bank statement; applicable sales tax or VAT is collected and remitted by Lemon Squeezy. By making a purchase, you agree to pay the listed price plus any applicable taxes. All sales are final unless otherwise stated. Subscription plans renew automatically at the end of each billing period unless cancelled before the renewal date. Refund requests must be submitted within 7 days of purchase. 6. User Conduct

You agree not to: (a) use the platform for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the platform; (c) upload malicious software or harmful content; (d) interfere with the proper functioning of the platform; (e) impersonate any person or entity; (f) scrape, data-mine, or use automated tools to collect content from the platform without prior written consent.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Penguin 3D AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Disclaimers

The platform and all 3D models are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that 3D models will be error-free, suitable for any particular production method, or meet specific dimensional accuracy requirements. Users are responsible for verifying model suitability for their intended manufacturing process.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to access the platform and any downloaded content licenses may be revoked.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of the jurisdiction where Penguin 3D AI is registered.
